Amazon loses bid to scrap historic union win at Staten Island warehouse

Amazon’s efforts to undo the outcome of its historic union victory at the Staten Island warehouse fell short on Thursday after a federal Labor Commission hearing officer rejected Amazon’s challenge to the election.

The decision is a win for the organizers of what could be a very long battle for recognition.

Warehouse workers known as JFK won decisively just after the spring vote Union elections in Aprilwhen it created the first unionized Amazon facility in the United States, the company filed more than 20 challenges to the National Labor Relations Board. and claimed it was contaminated by Region 29, the agency’s regional office in Brooklyn that oversaw the election. .

The 24-day hearings, Amazon’s unsuccessful attempt to keep private, resulted in tense back-and-forth between attorneys on both sides over which documents could be presented for evidence and which witnesses could testify. It was a feature.

An NLRB spokesperson reached the conclusion Thursday that it has dismissed Amazon’s objections outright and that labor unions should be authorized as bargaining agents for warehouses, the NLRB spokesperson said in an email. ing.

“Employers have not fulfilled their responsibility to establish that Legion 29, petitioners, or third parties engaged in objectionable conduct to influence the outcome of the election,” the spokesperson said, summarizing Dunn’s recommendations. provided.

Thursday’s victory is a relief for the Amazon Workers’ Union, a grassroots group of former and current workers.

Amazon union leader Derrick Palmer tweeted: “People talk, Amazon recognizes the Amazon union and it’s time to negotiate the deal.

Amazon spokeswoman Kelly Nantel said the company was planning another appeal.

“We are still considering the decision, but we strongly disagree with the conclusion and intend to appeal,” Nantel said in a statement. As you can see, both the NLRB and ALU are inadequately influencing election results, and I doubt it represents what the majority of our teams want.

Amazon, unions, and agency offices in Brooklyn have until Sept. 16 to file exceptions for reporting. This will send a case to the regional director, who will either certify the election results or order a rerun of the vote. You can appeal the order to the Labor Relations Commission.

Even when institutions support the union’s victory, experts say companies that don’t want unionized workers often refuse to negotiate. The move could spark a lengthy legal battle in federal court, which companies could use as a backdoor attempt to prevent workers from winning.

Union loses another election, weakens spirit

In May the new union lost another election. warehouse next door, dampened enthusiasm elsewhere. At the same time, it was devoting more time and resources to defending its first win against the e-commerce giant.

Other campaigns have begun at Amazon warehouses in states such as North Carolina and Kentucky to collect enough signatures to qualify workers for union elections. I applied for elections in the warehouse.
